Official Rules

No purchase or payment of any kind necessary to enter or win the Sweepstakes. A purchase does not increase chances of winning the Sweepstakes. Data rates may apply if entering using a mobile device.

Eligibility

Open to legal residents of the fifty (50) United States and the District of Columbia, who are at least eighteen (18) years of age (nineteen (19) in Alabama and Nebraska) at the time of entry. The following individuals are not eligible to enter or win a Prize: officers, directors, employees, representatives and agents of The Pepsi-Lipton Tea Partnership (the “Sponsor”) advertising or promotion agencies, (including Motive Group, Inc. and Southern Made Services, LLC), Nintendo of America Inc. and each of their respective parent, affiliated companies, subsidiaries, licensees, bottlers, distributors, dealers, retailers, printers and advertising and promotion agencies program prize suppliers, any other companies engaged in the development, production, or distribution of materials for the Promotion (the “Promotion Parties”), and members of their immediate families (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same household of each such person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Sweepstakes, as defined below).

Promotion Period

The Brisk® Gaming sweepstakes (“Sweepstakes”) and $5 Nintendo eShop Card Offer (“Offer”) begins 12:00 p.m. Eastern Time (“ET”) on July 23, 2026, and ends at 11:59 p.m. ET on November 28, 2026 (the “Promotion Period”). The Sweepstakes and Offer shall be collectively referred to as “the Promotion”. All individuals who participate (“Participants”) agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding on matters relating to this Promotion. The website server is the official clock for this Sweepstakes.

How to Participate

During the Promotion Period, there are two (2) ways to participate:

1. Website: Buy two (2) participating 1-Liter Brisk® products (“Participating Product(s)”) in one transaction at any physical store in the U.S. during the Promotion Period. Scan the QR code on POS or visit drinkbrisk.com/sweepstakes (the “Website”) and create or log into your account (“Account”). To create your Account, complete the online registration form which includes Participants’ complete first and last name, email address, date of birth, and also confirm that you have read and agree to the Official Rules. Select a retailer from the dropdown then submit an image of your full receipt for validation. Once your receipt has been validated, you will receive an email within 48-72 hours containing your Offer and confirming that you received one (1) entry into the Sweepstakes. Offer redemption instructions will be provided in the email. If you purchased your product at a Family Dollar store, you will receive an email in the above stated timeframe containing your Offer and will be entered in a drawing for a Family Dollar Grand Prize only. There is a limit of one (1) Account per person/email address. There is a Limit of 1 Offer per Account. Offer is available while supplies last.

2. Sweepstakes Mail-In Requests: To receive one (1) Sweepstakes Entry without making a purchase into the Grand Prize drawings handprint your name, complete address (no P.O. boxes permitted), date of birth, email address, phone number, on a 3” x 5” index card and mail in a hand-addressed envelope with proper postage affixed to: “Brisk® Gaming Sweepstakes”, P.O. Box 90365, Nashville, TN 37209. For Family Dollar Customers: To receive one (1) Sweepstakes Entry without making a purchase into the Family Dollar Grand Prize handprint your name, complete address (no P.O. boxes permitted), date of birth, email address, phone number, on a 3” x 5” index card and mail in an envelope with proper postage affixed to: “Brisk® Family Dollar Gaming Sweepstakes”, P.O. Box 90365, Nashville, TN 37209.

All Mail-In requests must be postmarked by no later than November 28, 2026, and received by December 7, 2026. Limit of one (1) Sweepstakes Entry per hand-addressed stamped outer envelope.

There is a limit of one (1) Sweepstakes Entry, per day, per person, regardless of entry method. A “day” is defined as a twenty-four (24) hour time period beginning at 12:00 a.m. ET and ending at 11:59 p.m. ET, except the first day of the Promotion Period which will be defined as beginning at 12:00 p.m. ET and ending at 11:59 p.m. ET.

All Website Sweepstakes Entries shall be deemed to be submitted by the authorized account holder of the email address used to register for the Promotion. “Authorized Account Holder” of an email is the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. You may only participate in the Promotion using an email address for which you are the Authorized Account Holder. An eligible prize winner may be required to provide proof that they are the Authorized Account Holder associated with the selected email address. By submitting an email address to register for the Promotion, you represent and warrant that you are the Authorized Account Holder. If a dispute arises regarding who submitted a website entry, the website entry will be deemed to be submitted by the Authorized Account Holder of the email address provided at time of registration. Standard data rates may apply if the Website is accessed via a mobile device, and Participants are solely responsible for any such charges.

Participants using any other device or artifice to enter multiple times above the stated limit or as multiple Participants will be disqualified. Sweepstakes Entries, generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Any incomplete, illegible, misdirected or postage due mail-in requests will be considered ineligible. Proof of submission is not proof of receipt by Sponsor.

Sweepstakes Entries are void if not obtained or submitted in accordance with these Official Rules or are obtained in another method which we determine, in Sponsor’s sole discretion, is in violation of these Official Rules.

Sweepstakes Drawings (“Drawings”) and Odds of Winning

Grand Prize Drawings will be conducted by the Administrator, from among all eligible Website and Mail-In entries (excluding Family Dollar) received on or about December 9, 2026. The Family Dollar Prize Drawing will be conducted by Sponsor’s representative, from among all eligible Family Dollar Prize Website and Mail-In entries received on December 9, 2026. Odds of winning a Prize depend on the number of Sweepstakes Entries received for each Drawing during the Promotion Period. Potential Winners will be randomly selected by the Administrator and will be notified via email within 2 days of the Drawing (“Winners”). The Sponsor’s decisions shall be final and binding on all matters relating to the Promotion.

Prizes (“Prizes”) and Approximate Retail Value (“ARV”)

Grand Prizes: Four (4) grand prizes (“Grand Prizes”) will be awarded during the Promotion Period. Each Grand Prize consists of one (1) Brisk x Splatoon Raiders Prize Pack which includes one (1) Nintendo Switch 2 system (ARV $449.99), one (1) Brisk x Splatoon Raiders t-shirt (ARV $7.00), one (1) Brisk x Splatoon Raiders koozie (ARV $0.85), one (1) Brisk x Splatoon Raiders Nintendo Switch 2 carrying case (ARV $16.00), one (1) Brisk x Splatoon Raiders premium magnetic box (ARV $25.00), one (1) download code for a digital version of the Splatoon Raiders game (ARV $49.99), and one (1) Brisk 12-oz lemon can (ARV $0.75). The ARV of each Grand Prize is $549.58. The ARV of all Grand Prizes is $2,198.32.

Family Dollar Prize: One (1) Family Dollar prize will be awarded during the Promotion Period. Each Family Dollar Prize consists of one (1) Brisk x Splatoon Raiders Prize Pack which includes of one (1) Nintendo Switch 2 system (ARV $449.99), one (1) Brisk x Splatoon Raiders t-shirt (ARV $7.00), one (1) Brisk x Splatoon Raiders koozie (ARV $0.85), one (1) Brisk x Splatoon Raiders Nintendo Switch 2 carrying case (ARV $16.00), one (1) Brisk x Splatoon Raiders premium magnetic box (ARV $25.00), one (1) download code for a digital version of the Splatoon Raiders game (ARV $49.99), one (1) Brisk 12-oz lemon can (ARV $0.75), one (1) tote (ARV $3.82), one (1) foam hat (ARV $4.50), one (1) pair of sunglasses (ARV $3.09), and two (2) patches (ARV $0.61 each/ total $1.22). The ARV of the Family Dollar Prize is $562.21.

Total of prizes in this Sweepstakes is $2,760.53.

Prize Restrictions

Winners are responsible for all applicable federal, state, local taxes and any costs, expense(s), or fees whatsoever in connection with the Prize. The Prize is non-assignable and non-transferable and is not redeemable for cash and no substitution will be made except as provided herein at the Sponsor’s sole discretion. All potential Winners are subject to verification by the Sponsor and the Administrator.

Prizes will be mailed to the mailing address collected during winner verification. Prizes may take 10-12 weeks to arrive. Shipping in the United States only. Winners shall bear all risk of loss or damage to prize after it has been delivered.

The Promotion Parties shall not be held responsible for any delays in awarding the Prizes for any reason. By participating in this Promotion, each Participant agrees: (i) to be bound by these Official Rules, (ii) to allow Sponsor to send program specific emails, and (iii) to release and hold the Sponsor and the Promotion Parties harmless from and against any and all claims, injuries, damages, losses and liability that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of the Prize or activity related to the receipt or use of the Prize. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control.

Limit one (1) Prize per mailing address during the Promotion Period.

Winner Notification and Prize Claim

Winners will be notified via email using the email address provided at the time of registration within 2 days of the Drawing. The potential Winners will have seven (7) days to respond with their acceptance of the Prize. Winners will also need to provide their mailing address.

Prize will be forfeited, and an alternate potential Winner may be contacted if: (1) a Prize notification is returned as undeliverable; (2) if any required response (including email response) is not received in seven (7) days for any reason; (3) if any Prize claim forms or Winner verification materials are not returned within 7-days; or (4) if any potential Winner is determined to be ineligible or otherwise not in compliance with these Official Rules. Sponsor, and Promotion Parties are not responsible for any change of email address, of Participants. Sponsor is not required to make more than one attempt to notify any individual potential Winner; nor is Sponsor required to make more than one attempt to verify an alternative Winner if the first selected potential Winner is disqualified. Prizes that are unclaimed, unredeemed, or returned as undeliverable will not be awarded. In the event that the Prize has been forfeited for any reason stated in these Official Rules, no compensation will be given.

General Conditions

In the event that, the Sponsor is unable to award any Prize as described in these Official Rules (including if the designated Prize should become unavailable for any reason), the Sponsor may substitute the Prize with another Prize of similar nature and equal or greater value at its sole discretion. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. If the Promotion is not capable of running as planned for any reason, including without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right, in its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify, or terminate the Promotion. In Sponsor’s sole discretion, any portion of the Promotion is not capable of running as planned for any reason, or the integrity and/or feasibility of the Promotion is severely undermined by any event beyond the control of Sponsor, including but not limited to fire, flood, health pandemic or epidemic, earthquake, explosion, extreme weather conditions, interruptions in air travel, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, technical failures or other cause not reasonably within the control of Sponsor (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Promotion without any further obligation. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor, such as by way of example and not by way of limitation, in a random drawing from among all eligible, non-suspect entries received up to the time of the impairment, and Sponsor shall not have any further liability to any Participant in connection with the Sweepstakes. Sponsor may modify and amend these Official Rules as they appear online from time to time during the Promotion Period for clarification purposes without materially affecting the terms and conditions of the Promotion. In no event will more than the number of Prizes stated in these Official Rules be awarded. If a Sweepstakes Entry is confirmed to have been erroneously deleted, lost, or destroyed, the Participant’s sole remedy shall be another Sweepstakes Entry into the Sweepstakes.

Limitations of Liability and Release

As a condition of entering, Participants agree to release the Sponsor, and Promotion Parties, (collectively, “Releasees”) from any and all liability, loss, or damage incurred with respect to Participant’s participation in the Promotion and the awarding, receipt, possession, and/or use or misuse of any Prize. No liability or responsibility is assumed by the Releasees resulting from user’s participation in, attempt to participate in, or download of any information in connection with participating in the Promotion. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Participant or by any of the equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of the Sweepstakes Entries. No responsibility or liability is assumed by the Releasees for technical problems or technical malfunction, including, without limitation, those arising in connection with any of the following occurrences that may affect the operation of the Promotion: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed, or intercepted email transmissions; inaccessibility of any website in whole or in part for any reason; traffic congestion on the Internet or any website; unauthorized human or non-human intervention in the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Promotion. Sponsor is not responsible for any typographical errors in the announcement of Prizes or these Official Rules, or any inaccurate or incorrect data contained on promotional materials or on the Website. Use of any website is at user’s own risk. Releasees are not responsible for any personal injury or property damage or any other losses of any kind that may be sustained to user’s or any other person’s computer equipment resulting from participation in the Promotion, use of any website or the download of any information from a website or any other loss related to user’s participation in the Promotion or receipt of any Prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU, AND THE FOREGOING PARAGRAPHS SHALL NOT APPLY TO A RESIDENT OF NEW JERSEY TO THE EXTENT DAMAGES TO SUCH NEW JERSEY RESIDENT ARE THE RESULT OF SPONSOR OR PROMOTION PARTIES’ NEGLIGENT, FRAUDULENT OR RECKLESS ACT(S) OR INTENTIONAL MISCONDUCT.

Binding Arbitration

Any controversy or claim arising out of or relating to the Promotion shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply New York law consistent with the Federal Arbitration Act and applicable statutes of limitations and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal (other than that claim will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS. If, however, the portion that is deemed invalid, unenforceable, or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE PARTICIPANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS PROMOTION IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.

BY PARTICIPATING IN THIS PROMOTION, EACH PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) PARTICIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY PARTICIPANT.

Submission of a Sweepstakes Entry or submission of any Prize notification documents, constitutes your consent for Sponsor to obtain, use, and transfer your information for Promotion administration purposes and shall be subject to the Pepsi’s Privacy Policy available at https://www.pepsico.com/privacy.

Governing Law & Jurisdiction

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Participants rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules thereof. By entering, Participants consent to the jurisdiction and venue of the federal, state, and local courts located in Westchester County, New York for the resolution of all matters or proceedings which are not subject to arbitration as set forth in the Binding Arbitration clause of these Official Rules and agree that any and all such disputes shall be resolved exclusively in those courts. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
